Text Alerts
MBUSA provides certain services through recurring SMS alerts through MBUSA News & Announcements, MBUSA Vehicle Alerts, and MBUSA Polls and Surveys (collectively “Text Alert Programs”). By entering your mobile phone number(s) and successfully activating any of the Text Alert Programs, (i) you acknowledge and represent that you are the authorized user of the mobile phone(s) that you subscribe to the text alert service or have been granted permission by the authorized user of the mobile phone(s) to enroll such mobile phone(s) in the service; (ii) you grant MBUSA express permission to send text messages to the registered mobile phone(s) through your wireless phone carrier unless and until such permission is revoked in accordance with these terms and conditions; and (iii) by granting such permission to MBUSA you are hereby requesting to receive such messages in spite of the fact that your number may otherwise be on the federal, or a state's, do not call list and you agree, to the maximum extent permitted by law, that such text messages shall not be in violation of such do not call list(s).
Activate Text Alerts:
To activate MBUSA News & Announcement Text Alerts, text “MBUSA” to 81665. Reply “Confirm” to opt-in to SMS messaging. 5 msgs./month. Msg&data rates may apply
To activate MBUSA Vehicle Alerts, text “JOIN” to 87361. Reply “Agree” to opt-in to SMS messaging. 5 msgs./month. Msg&data rates may apply
To activate MBUSA Polls and Surveys, text “SIGNUP” to 78891. Reply “Yes” to opt-in to SMS messaging. 5 msgs./month. Msg&data rates may apply
You will be asked to verify your mobile phone number before the service will start. This requires responding to a text alert sent to your mobile phone confirming your enrollment in the applicable Text Alert Program. By signing up for any of the Text Alert Programs, you agree to these Text Alert Terms and Conditions. There is no charge from MBUSA for Text Alert Programs, but YOUR SERVICE PROVIDER’S MESSAGE AND DATA RATES MAY APPLY. You are solely responsible for all message and data charges that you incur. Please contact your mobile service provider about such charges. Texts may be sent using an automatic telephone dialing system. You acknowledge and understand that SMS messages are sent without encryption, which presents some security risk.
Stop Text Alerts: You may opt out of MBUSA’s Text Alert Programs at any time. To stop receiving text alerts, text “STOP” to the number from which you are receiving text alerts. Your text message should contain only the word “STOP” without any additional words, spaces, or characters either before or after the word “STOP.” MBUSA will reasonably endeavor to comply with other text communications in which you indicate a clear and unmistakable intent to revoke your prior permission; however, you (a) understand that these messages go to a short code number that is entirely automated, is not monitored by a human, and the ability of our short code box to interpret your intent is severely restricted and, therefore, (b) you hereby release MBUSA from any liability for your efforts to revoke your permission via a text message that does not strictly comply with the terms stated above. After you submit a request to unsubscribe, you will receive one final text alert from MBUSA confirming that you will no longer receive text alerts from the applicable Text Alert Program. No additional text alerts will be sent unless you re-activate your enrollment to the Text Alert Program. You agree that your prior express consent to receive text alerts shall continue indefinitely unless and until you comply with one of the methods described above for cancelling your prior express consent. Other methods or means attempted to revoke your prior express consent (e.g. a letter sent to an MBUSA address, an email sent to an MBUSA email address, a voicemail message left with an MBUSA employee, etc.) shall be ineffective.

Message Frequency: Message frequency will depend on the Text Alert Program(s) you activate.

No Warranties: MBUSA makes no representations or warranties whatsoever regarding the Text Alert Programs. MBUSA hereby disclaims all warranties, including any implied representations or warranties of merchantability or fitness for a particular purpose. The Text Alert Programs are offered on an “as is” basis and: (1) may not be available in all areas at all times; and (2) may not continue to work in the event of product, software, coverage or other service changes made by your wireless carrier. MBUSA may change or discontinue any of its text alert programs without notice or liability to you. MBUSA and its related companies and each of their respective officers, directors and employees are not responsible and shall not be liable for any losses or injuries of any kind resulting, directly or indirectly, from any Text Alert Program or from technical failures or delays of any kind. MBUSA reserves the right to cease delivery of text alerts to any person at any time in its sole discretion.
Limitation of Liability: To the maximum extent permitted by applicable law, you hereby agree that MBUSA shall not be liable for any direct, indirect, consequential, special, incidental, punitive, or any other damages relating to your use or receipt of or failure to receive text alerts. Furthermore, MBUSA and the mobile carriers (including T-Mobile) are not liable for delayed or undelivered messages.
Indemnity: To the maximum extent permitted by applicable law, you hereby agree to indemnify and hold harmless MBUSA, its subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use or receipt of or failure to receive MBUSA’s text alerts.
Governing Law; Enforceability: These terms shall be construed in accordance with the laws of the State of Georgia, and any arbitration or judicial proceedings to enforce or interpret the terms hereof may be brought only in the State of Georgia. If any part of these Text Alert Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Text Alert Terms and Conditions, and the remaining portions shall remain in full force and effect.

Changes in Terms: MBUSA reserves the right to change these terms or cancel the text alerts at any time. Please check these Text Alert Terms and Conditions on a regular basis for changes. Your continued use and acceptance of text alerts after changes are posted will mean that you accept the terms as modified by the posted changes.
