Learn about how the information we collect through the Mercedes-Benz platform and Connected Vehicle Services is used, stored, and shared, and explore your choices for managing our use of your information.
This privacy policy (“Privacy Policy”) consists of three parts relating to the following: Part I describes how Mercedes-Benz Canada Inc. (MBC) protects the privacy, confidentiality, accuracy, and security of your personal information that we collect, use, share, or retain in the ordinary course; Part II describes how MBC protects the privacy, confidentiality, accuracy, and security of your personal information that we collect, use, generate, store, share and retain when you utilize our connected vehicle services; and Part III, contains general information which is applicable to both Part I and Part II of this Privacy Policy. Part I
1. Introduction
At MBC, we demonstrate our commitment to protecting the personal information of our customers through this Privacy Policy. This Privacy Policy describes which personal information we collect, and how we use, disclose, and retain that information at MBC.
We reserve the right to change this Privacy Policy from time to time and provide notice of any significant changes, and their effect, on MBC’s Website. In addition, we include a revision date on each version of this Privacy Policy. By providing personal information to us, or continuing to use our products or services after that date, customers consent to the collection, use and disclosure of their personal information as set out in this Privacy Policy.
2. How Does MBC Collect Personal Information?
MBC collects personal information and other information in a variety of ways, depending on an individual’s manner of association or interaction with MBC. We describe the main ways in which we collect personal information below.
From you Directly: We may collect information directly from customers when they provide it to us (for example, such as when they contact us or when they enter their personal information on the Websites), indirectly from their devices and online use, from other third parties, from a customer’s vehicle and, depending on the services or features you use, from special services or features we provide or which customers purchase.
Personal information may also be collected through customer surveys, marketing questionnaires and promotions to understand customer interests related to vehicle purchases and to provide tailored services or offers to customers and prospective customers, where we have obtained consent to contact such persons.
From customer devices: We collect information from customers’ devices, including as follows:
- Information about your use of our Websites, via cookies (see below), pixels and other digital markers, mobile applications and any use of a browser to access any type of online services relating to MBC, such as Media Access Control (MAC) address, type of computer or device, screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version, the name and version of the services (e.g. the Mercedes me App) the customer is using and timing and frequency of use of the services. This information is used to enhance our advertising and offering to you, to provide you with a tailored experience in using such media.
When you visit an MBC Website, MBC or our advertisers or other third parties may send a “cookie” to a person’s computer. Individuals may be able to choose whether or not to accept cookies by changing the settings of their Internet browser, but some functionality of the Website may be impaired or not function as intended.
From other third parties: We may also collect personal information from other sources, such as, government agencies, MB dealers, MBFS, insurance providers and others. Typically, we may:
- Collect personal information provided by customers to MB dealers to facilitate the purchase of customer warranty purchases and the fulfillment of warranty claims and we may share repair or maintenance information about a customer’s vehicle when that customer seeks service from other providers.
- We collect customer contact information, repair and service details, VIN and vehicle contract information from MBFS and/or MB dealers to maintain a comprehensive customer record that may be accessed in order to address customer inquiries and to potentially create targeted offers to the customer, where customer has provided consent to such marketing.
- We may obtain information about customers from government agencies in order to ensure that customers have not violated their agreement regarding exporting a vehicle or in order for MBFS to locate and repossess a leased or financed vehicle.
- We also may receive personal information that customers have provided to certified installers, third-party vehicle repair or service centres, third party service providers such as providers of certain features within the Mercedes me App, social media platforms and to MBC’s joint marketing partners.
From the vehicle: Telematics refers to the use of wireless devices and technologies to transmit data in real time back to an organization. Many Mercedes-Benz vehicles are equipped with telematics functionality. MBC may collect certain telematics data regarding the performance, usage, operation, and condition of a customer’s vehicle to improve our vehicles and services. The types of data collected will vary among vehicle models, as well as the types of services available or selected by the customer. For further detail on the collection, use and processing of your personal information for connected vehicle services, please see Part II of this Policy.
3. What Personal Information Does MBC Collect?
The personal information MBC collects depends on how you interact with us, and the transactions you enter into with us or our Affiliated Businesses.
We describe the personal information we collect in more detail below:
- We may collect and use the personal contact information of customers, for instance, customer name, email addresses, phone numbers, address, country of residence, and other registration and transaction information in order to communicate with customer.
- Customers who wish to arrange vehicle financing through MBFS may be asked to provide their address, driver’s license number, year of birth, property ownership status, mortgage/rent payment, balance, social insurance number (optional), employment information/history, income, banking information and information about legal actions they may be involved in. MBC sends this information to MBFS, where credit may be approved or declined. Personal Information possessed by MBFS is handled in accordance with MBFS’s Privacy Policy, available here: Terms of Use And Privacy | Mercedes-Benz Financial Services (mbfs.com).
- Payment information, including payment card or account information, if a customer makes a purchase so that we can process the transaction.
- Information about the vehicle with which the customer is associated, such as vehicle type, purchase information, service data, service and repair history, recall information, which information we use to administer warranties and maintain and service records.
- Information about a vehicle that customer is interested in purchasing, such as vehicle type, vehicle cost and additional options and features.
- Your location information, which may include general location from your IP address, or, vehicle geolocation, with your express consent as referenced in the Mercedes me App terms of use of telematics data), unless vehicle location is needed for purpose of compliance with law.
- We may collect name and contact information of customers who participate in an online chat (where available) together with the record of the chat, with one of our MBC representatives so that we can locate our discussion and follow-up if necessary.
- We may collect records of any and all written communications you have with MBC (such as emails, letters, text messages).
- We may collect personal information such as name, email addresses, address, dietary restrictions/ allergies (if we serve food) and size (if we give away apparel) of customers, prospective customers and MB dealership personnel who attend any type of MBC marketing event, sign up for a test drive, place an order over the phone, or make inquiries of MBC’s customer services or sales department.
- Information about your use of our Websites, via cookies (see below), pixels and other digital markers, mobile applications and any use of a browser to access any type of online services relating to MBC, such as Media Access Control (MAC) address, type of computer or device, screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version, the name and version of the services (e.g. the Mercedes me App) the customer is using and timing and frequency of use of the services. 4. For What Purposes Does MBC Collect and Use Personal Information?
At MBC, we identify to our customers the purposes for which we collect their personal information at or before the time of collection, or in some cases should the manner in which we use that information change. We make this information available to customers through this Privacy Policy, our Websites, privacy notices, and other informational materials available at MB dealerships.
We may collect and use personal information to:
- Provide our customers with MBC products or services and related activities, such as administering vehicle warranty programs, customization, financing and leasing through MBFS, recalls, test drives, and customer loyalty programs;
- Initiate, maintain, and improve our relationship with our customers by providing them with personalization of their experience, including to: remember customer interests and preferences; maintain a comprehensive record of a customer’s interactions with us, the Affiliated Businesses and independently owned and operated Mercedes-Benz dealerships; customize the products and services we share with customers; facilitate customer interactions with our employees; track and categorize customer activity and interests on our Websites and mobile application; and to enrich the customer experience on our Websites and through our mobile application; for information on how to opt-out of the sharing or use of your personal information for marketing, please write to the MBC Privacy Officer at:

- Communicate with our customers, such as: responding to a customer when they place an order; call us; make a request or inquiry; enter a contest or sweepstakes; complete a survey; or share a comment or concern. As well, we use this information to respond to and investigate customer inquiries, send customers newsletters, vehicle information, brochures, alerts or other materials; to request and provide feedback; and to facilitate social sharing and communication;
- Facilitate a transaction and provide products and services, such as: to complete and fulfill a purchase or order, to process a payment, process, maintain or service an account or membership, have an order delivered, communicate regarding a purchase; service an account and provide related customer service;
- Improve our products and services through quality assurance and improvement activities, including to: develop and promote new products and services; to improve or modify our existing products and services; and to analyze and improve the safety and security of our products and services;
- Monitor vehicle performance and provide services related to the vehicle, such as: contact the customer with service recommendations and to deliver over-the-air updates to the vehicle; to deliver any services requested by the customer; and comply with legal and contractual requirements;
- Perform analytics, such as to understand how customers use our Websites, mobile applications, products and services; generate insights and understand how customers interact with us; and improve our Websites, mobile applications, products and services;
- Operate and improve upon our business and lawful business activities; to maintain our programs, accounts, and records; for research and development; to determine customer satisfaction with our products and services; to detect and prevent fraud or misuse of our services;
- Locating (and facilitating MBFS’ potential repossession of) a leased or financed vehicle exported from Canada in violation of agreements or to monitor compliance with such agreements;
- Defend or protect us, our customers, or third parties, from harm or in legal proceedings; protect our rights; protect our security and the security of our customers, employees, and property; respond to court orders, lawsuits, subpoenas, and government requests; address legal and regulatory compliance; and notify customers of product recalls or safety issues;
- Where customers opt-in to the activation of a SIRIUS Satellite Radio free trial, MBC provides SIRIUS Satellite Radio with a customer’s name, address, phone number, vehicle identification number, and SIRIUS Satellite Radio serial number.
MBC may also anonymize, aggregate or otherwise strip any personal information or other information we collect of all personally identifying characteristics and may use or share that aggregated, anonymized data with third parties for any purpose we deem appropriate.
5. MBC Collects Personal Information with Consent; Withdrawing Consent
We obtain the consent of customers for the collection, use, or disclosure of their personal information, except where such consent is not required under applicable law. For sensitive uses and disclosures of personal information, we obtain the express consent of customers. In addition, we obtain the implied consent of our customers by providing notice of our privacy practices through this Privacy Policy, located throughout independently owned and operated Mercedes-Benz dealerships and on our Websites.
Customers may choose to withdraw their consent for certain uses and disclosures of their information by MBC, subject to legal or contractual restrictions and reasonable notice.
Customers can opt out of these uses and disclosures by contacting our MBC Privacy Officer (see “How to Contact MBC” section below).
If customers have consented to the sharing of their personal information with SIRIUS Satellite Radio as referenced above, and they subsequently wish to withdraw this consent then customers must contact SIRIUS Satellite Radio directly to do so.
6. Retention of Personal Information
MBC retains customer personal information as long as it is required for our business relationship, and in accordance with our applicable policies, procedures and retention periods, which are based on the following: the purposes shared with you at the time the information was collected or for any subsequent purposes consented to by you; as required by law; potential risks which customer personal information is applicable to; backup of information; and business continuity.
7. When does MBC disclose Personal Information to other parties?
We may disclose personal information to third parties, including the following:
- To MBFS, government institutions (e.g. departments of motor vehicles or other relevant agencies), and insurance providers in order to process and administer the purchase, lease, finance, or maintenance of a vehicle. For clarity, MBC does not share information with insurance providers in respect of driver behaviour
- To third party marketing, communications and contest providers, who facilitate promotions, surveys, events, campaigns and/or loyalty programs, if a customer elects to participate;
- To business partners, such as:
- Mercedes-Benz dealerships, in order to provide them with customer contact information and history, to facilitate their provisions of services to customers, such as customer support and vehicle maintenance, and including, with your consent, to allow Mercedes-Benz dealerships to provide marketing and promotional materials to you. We may also provide Mercedes-Benz dealerships with information regarding the services or products you have purchased where necessary to allow the Mercedes-Benz dealership to carry out service or maintenance you have requested.
- SIRIUS Satellite Radio and Roadside Assistance, so that they can provide our customers with products and services on a time-limited trial or fee-for-service basis from these businesses.
- Ipsos GmbH and Ipsos America, Inc., so that these businesses may request information from customers concerning the quality of our services and products as well as conduct market research so that we can better understand our customers and their needs.
On rare occasions, we may disclose customer personal information without customer knowledge or consent where we are required to do so by law or permitted to do so by law.
We may share personal information with our service providers and business partners when necessary to perform services on our, or on the customer’s behalf, such as:
- With our Affiliated Businesses, in their capacity as our service providers who may provide the vehicles, products and services that you choose to receive or who use the personal information to service or improve the vehicles, products and services you receive.
- With third parties that provide services to MBC, such as web hosting, data analytics, payment processing, IT services, voice command processing, customer service and similar processing activities.
- With our business partners to help develop and market programs, promotions, campaigns, products or services and present targeted content including targeted advertising.
- With other third party businesses, if they are involved in the transaction a customer is engaged in (e.g., finance companies, leasing companies, registration services, title registration, or with e-Mobility Service Providers to facilitate EV charging services).
In the event that MBC, any of its Affiliated Businesses, brands or substantially all of any of their assets are acquired by a third party, customer personal information may be one of the transferred assets. By providing personal information to us, customers agree that we may disclose their personal information, on a confidential basis, to any prospective transferee and its professional advisors for the purposes of their due diligence investigations, the completion of any such transaction and the continued operation of the acquired business.
8. How does MBC Protect Personal Information?
We use physical, organizational, and administrative means to help protect personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification with security safeguards appropriate to the sensitivity of the personal information. We protect personal information regardless of the format in which it is held.
At MBC, we comply with industry practices and employ reasonable security procedures to protect personal information in our custody and control. These include, but are not limited to, the following safeguards:
- Administrative Safeguards: We employ reasonable administrative safeguards, such as this Privacy Policy, confidentiality agreements, and contracts, to help ensure that all MBC employees (permanent and contract) access personal information for authorized purposes only. Personal information may be accessed by persons within our organization, or our third-party service providers, who require such access to carry out the purposes described in this Privacy Policy, or otherwise permitted or required by applicable law. We train our employees (permanent and contract) to understand and follow the practices outlined in this Privacy Policy, and regularly remind them of their privacy responsibilities.
- Technical Safeguards: We employ reasonable technical safeguards, such as passwords, encryption, clear screen policy, the use of closed networks, and role-based access controls, for information systems from which personal information may be accessed.
- Physical Safeguards: We employ reasonable physical safeguards to protect personal information, such as by locking filing cabinets and by restricting physical access to offices and data centres.
We also protect the personal information we destroy and dispose of in order to prevent unauthorized parties from gaining access to the information during this process.
Whilst we maintain the above-referenced safeguards, we cannot guarantee or warrant the security of your personal information, especially during data transmission.
If you have any reason to believe that your account, transaction or information is no longer secure, you should contact us immediately (see the “How to Contact MBC” section below.)
If Customers sell or transfer their vehicle to another person it is recommended that they take additional steps to safeguard their personal information from being disclosed to the new owner of the vehicle, such as deleting their information from the MBUX display in the vehicle.
9. MBC may Transfer Personal Information to Other Countries
Please note that personal information may be stored, accessed and processed outside of your province or territory of residence, including outside of Quebec, and in any country where MBC or its Affiliated Businesses are located, or engages service providers, including in the United States and certain countries within the European Union, including Germany. Those jurisdictions may not have the same data protection laws as Canada. and personal information stored in other jurisdictions may be accessed by foreign governmental authorities and law enforcement institutions in accordance with the laws of those jurisdictions. By using our products, the services, or otherwise providing information to us, customers consent to the transfer of their personal information to jurisdictions outside of Canada, and their province/territory of residence, including outside of Quebec.
10. Correction and Access to your Personal Information. Your Choices.
At MBC, we make reasonable efforts to ensure that personal information we use or disclose is as accurate, complete, and up to date as is necessary for the specified purposes.
Some customer information can be modified or corrected by the customer if they log in to their account to make such changes. Customers may also contact us should their information (e.g. address, vehicle ownership information) change (see “How to Contact MBC” section below).
Upon your written request by you, we will:
- inform you of whether we do possess your personal information and, where required under applicable law (including in Quebec), provide information on how that information is processed;
- give you access to your personal information possessed by us, subject to applicable laws and this Privacy Policy;
- update your personal information in our possession, if you believe that the information we have is incorrect or incomplete, provided we are able to do so and provided such update is permitted by law.
Subject to applicable data protection laws, you may have certain other rights related to your personal information. Under certain circumstances and supported by a written request and adequate proof of identification, you may have the right to data portability, the right to restrict the processing of your personal information, the right to object or withdraw consent to the processing of your personal information, and the right to lodge a complaint with a regulatory authority.
You may write to us at any time to withdraw your consent to MBC’s use or disclosure of your personal information, or ask MBC to delete your information. However, we may determine that we cannot delete the information if we need to retain it, subject to applicable law, contractual requirements and business need.
All written requests to MBC by you relating to your personal information in our possession can be made by contacting our Privacy Officer (see “How to Contact MBC” section below). If MBC is unable to provide access to all of the personal information that we hold about you, we will provide the reasons for denying your request.
You will be required to provide sufficient information so that we can confirm your identity and process the request. We only use the information provided to accurately locate the personal information and verify your right to access it.
We will respond to all requests for access to information at no cost to the individual. In the case where there is a cost associated with processing the request, we notify the customer in advance. The customer may then choose to withdraw his/her request.
Please note that we may need to retain certain information for recordkeeping or legal compliance purposes and/or to complete any transactions that a customer began prior to requesting such change or suppression (for instance, if a customer makes a purchase or enters a promotion, we may be unable to change or suppress the information provided until after the completion of such purchase or promotion). There may also be residual information that will remain within our databases and other records, which will not be removed.
11. About Mercedes Benz Financial Services and other Third Parties
Within this MBC Website, specific services or functions provide you with the ability to apply for financing or manage your account with MBFS. Specifically, this may be found under the sections “Apply for Financing” and “My Account”. By participating in these services, you will be required to consent to providing personal information directly to MBFS. The details of how this information is collected, its use, and handling are documented within the MBFS Privacy Policy, available here: Terms of Use And Privacy | Mercedes-Benz Financial Services (mbfs.com). Under no circumstances should you provide this information if you do not agree with the terms of the MBFS Privacy Policy. It also includes the necessary contact information for MBFS in the event you wish to update your personal information, opt-out of marketing material, or address any other privacy concerns relating to MBFS.
The management of personal information by our Affiliated Businesses and business partners is governed by the privacy policies of those businesses and is not the responsibility of MBC. Please contact these businesses directly for information about their respective data management practices.
Part II
Connected Vehicle Services
Read how information is collected, generated, stored and shared by your vehicle when you utilize our connected vehicle services.
1. Introduction to Connected Vehicle Services
When you purchased or leased your model year 2019 or newer Mercedes-Benz vehicle, you became eligible to subscribe to our connected vehicle services which are collectively named Mercedes me connect. Mercedes me connect unlocks access to a package of innovative services, products, and lifestyle offers from MBC and our cooperation partners, including, but not limited to, parking assist, live navigation assistance, integration of popular mobile apps and emergency services at the push of a button, remote access to your vehicle to start and lock/unlock your vehicle, remote access to vehicle maintenance and much more.
This Part II of the Privacy Policy explains MBC’s practices regarding the collection, use, and sharing of information that is collected, generated, recorded, used, disclosed or stored when you use our Mercedes me connect services (“Connected Vehicle Information”).
When you use a vehicle with Mercedes me connect convenience services and safety and security services, which include emergency crash notification, airbag deployment notification, and stolen vehicle location, we and our service partners collect certain information, which includes geolocation information and driver behaviour information as described below. How we use your information will depend on which services you use, how you use those services, and the choices you make in your settings.
Even if you have not activated Mercedes me connect services, your vehicle may collect and transmit geolocation information and driver behaviour information in a collision or potential emergency. See your vehicle’s Operator’s Manual for more information.
By purchasing or using a vehicle equipped with Mercedes me connect services, using Mercedes me connect services, subscribing to Mercedes me connect services, or creating a Mercedes me account, you consent to the practices described in this Privacy Policy. With certain exceptions, you are free to withdraw your consent at any time. See the section below “Your Choices” for more information.
2. The Information We Collect
We collect a variety of information when you use your connected vehicle and the Mercedes me services. This information falls into the general categories below:
- Driver Behaviour Information: Information about how you drive your vehicle, such as vehicle speed, seat belt use, acceleration, trip duration, and braking habits.
- Geolocation Information: Information about the precise geographic location of your vehicle.
- Account Information: Information that you may provide when you subscribe to or register for Mercedes me connect, such as name, address, payment information, telephone number, personal email address, language preferences, subscriptions, and other personal information (e.g., height) that you may choose to share with us so that we can provide the Mercedes me connect services, personalize the Mercedes me connect services, and communicate with you.
- Vehicle Data: Data about your vehicle, including remote services and vehicle setup information such as remote lock, unlock, climate control vehicle status etc., data generated by the sensors and software in your vehicle, such as diagnostic trouble codes, maintenance conditions, engine performance, system temperatures, mileage, tire pressure, fuel level and average fuel consumption, battery charge information, door and window status, sensor status, climate control settings, charging status, charger type, impact data, and fuel economy (which may include travel data such as the average speed, fuel consumption and kilometres driven as well as the odometer reading of the vehicle), software version information, infotainment system data, safety-related data and camera images, (including, e.g., information regarding the vehicle’s SRS systems, braking and acceleration, security, and accidents);. Vehicle data may include your vehicle’s VIN, speed information, Driver Behaviour Information and Geolocation Information (used to provide emergency response or breakdown services, to provide navigation services upon your use of the in-vehicle navigation system and other location-based services you expressly choose to subscribe to). Vehicle Data may also include voice recordings made to support voice-activated services and other data to assist in identifying issues and analyzing the performance of the vehicle.
- System Information:Information about how you interact with vehicle systems, including use of multimedia screens, recent service requests, presets and other settings or selections in the vehicle.
- Service-Related Information: Information related to the availability, use of, or access to Mercedes me connect services and features, including charging station information, your chosen routes, calendar entries, contact numbers, points of interest, eligibility for services, available parking spaces, information requests, traffic information, hazard information, service activation requests, and credentials for multimedia services.
- Navigation Information: Information regarding the vehicle status and environment (such as the current vehicle position, speed of the vehicle, vertical and horizontal acceleration, solar radiation, outside temperature, whether the windshield wipers were on, the status of the headlights, time and date), objects identified by the vehicle's sensors in a certain position (such as street signs, street curves, lane markings, obstacles on the road) and their additional details (such as what type of obstacle was identified, where it was located relative to the vehicle, and its speed).
We may collect the above information remotely and/or at regular intervals while your vehicle is in use. We may collect such information either in person (such as during a service appointment) or viaremote access.
For example:
- The telematics data collected by MBC may include: vehicle identification number; speed information; mileage; fuel level and average fuel consumption; tire pressure; battery charge information; electrical system functions; software version information; infotainment system data; safety-related data and camera images, (including, e.g., information regarding the vehicle’s SRS systems, braking and acceleration, security, and accidents); information regarding the use and operation of various features; geoposition and location information (used to provide emergency response or breakdown services, to provide navigation services upon your use of the in-vehicle navigation system and other location-based services you expressly choose to subscribe to); and other data to assist in identifying issues and analyzing the performance of the vehicle. We may collect such information either in person (such as during a service appointment) or via remote access.
- In vehicles in which an emergency call system is activated, MBC may collect: the vehicle’s geoposition data and the geoposition data of the route (i.e. several hundred metres immediately before the triggering incident occurred); the direction of travel; vehicle identification number; if the vehicle is a car, the type of vehicle drive (e.g. petrol engine, electric vehicle, hybrid vehicle); the estimated severity of the accident; whether or not the vehicle supports accident management; whether Mercedes me connect is available or not; whether the emergency call was triggered automatically or manually; the time of the triggering incident; and the language setting in the multimedia system.
- MBC may be able to remotely connect to a customer’s vehicle to diagnose and resolve issues with the vehicle. This also enables MBC personnel authorized to provide assistance via this customer assistance platform to view the current location of the vehicle.
- We may collect and store other vehicle data such as: accident information (e.g., air bag deployment, sensor data); remote services/vehicle setup information (e.g., remote lock/unlock, climate control, vehicle status, etc.); vehicle connectivity information; data about issues that could materially impair operation of the vehicle or safety-critical issues; and data about each software and firmware updates. We may collect such information either during a service appointment or via remote access.
- In order to facilitate the servicing of the vehicle, we may collect and process data about the service history of each vehicle, including customer name, vehicle identification number, repair history, outstanding recalls (if any), any customer complaints, and other information related to its service history.
From special features:
Customers may subscribe to or expressly consent to the purchase of certain features in their vehicle, for instance, geofencing, vehicle tracker, or other features which make use of geoposition and location information of the vehicle, emergency response or breakdown services, and other location-based services you choose to subscribe to, and we may share this data with business partners and service providers that facilitate our provision of the service.
Customers may contact us (see “How to Contact MBC” section below) to enquire about stopping the transmission of MBC telematics data or other vehicle data. To stop transmission, disablement of the vehicle’s telecommunications module will be required. This can only be performed by a Mercedes-Benz technician. Once the unit is disabled, we will not be able to notify the customer of vehicle issues in real time, which may reduce vehicle functionality, result in serious damage to, or inoperability of, the vehicle. In addition, if customers do not provide telematics data, this may result in many features of the vehicle being disabled, including remote services, interactivity with the Mercedes me connect mobile app, and any service or feature that utilizes wireless internet communication.
3. How the Information is Used
We are committed to using the information we collect only in ways that are consistent with the context in which we collected the information and consistent with the choices that you make, including in the following ways and for the following purposes below:
Account Information: We use this information (often in combination with other information) to, among other things, provide the Mercedes me connect services that you activate or request and to communicate with you regarding your Mercedes me connect services and your vehicle. Some types of information (e.g., height to adjust comfort and seating preferences) may be used to personalize certain services. If you have provided payment card information, we will use that to process transactions.
Driving Behaviour Information: We may use Driving Behaviour Information for the general purposes described herein including providing driver safety services. In addition, some specific Mercedes me connect services may involve the use of Driving Behaviour Information.
Geolocation Information: We use the Geolocation Information to provide emergency response or breakdown services, to provide navigation services and help you find destinations that you are looking for. In addition, some Mercedes me connect services are primarily location-based. Live Traffic Information, navigation-related Services, Car-to-X communications, Stolen Vehicle Assist, Remote Vehicle Finder, Vehicle Locator, Geofencing, Online Routing, Valet Protect & Curfew Minder, Mercedes-Benz Apps, and Product Improvement services, for example, involve the collection of Geolocation Information to determine the location of your vehicle.
Vehicle Data: We use this information to, among other things, remotely diagnose your vehicle, assist with maintenance needs, and confirm vehicle quality. This data (in particular fuel economy data) may also be used to provide you with the ability to compare your vehicle’s fuel consumption with that of other Mercedes me connect vehicles and make efficiency suggestions. Voice data may be used to manage the activated services that use voice commands.
System Information: We use this information to, among other things, learn how you and others interact with the vehicle and its systems.
Service-Related Information: We use this information to, among other things, help you manage your vehicle service and maintenance, confirm vehicle quality, and activate remote services that you elect to receive.
Navigation Information: Real-time street information and real-time weather information is collected by the vehicle. We use this information to generate and improve maps, navigation services, and street information. Vehicle geolocation will be transmitted to Mercedes-Benz Group on a regular basis, and at certain locations the vehicle may be prompted to transmit additional data. We use the information above more generally to improve vehicle safety, create and respond to security alerts, (e.g. relating to cybersecurity matters), develop new and better vehicles, improve our Mercedes me connect services and other services, and analyse vehicle trends.
We may also use this information to conduct marketing, including interest-based marketing and advertising for us and on behalf of third parties (subject to any required consents). Occasionally, we will need to protect our, and our Affiliated Business’’ rights or business interests and we may also use it for those purposes.
We may also use the information we collect consistent with your authorization or consent.
4. Information Sharing
In order to provide you with Mercedes me connect services, we may share or transfer your information with others who process it on our behalf (in which case, they may only use it for the purposes you have consented to, and we pass that restriction along to them).
If you have allowed us to do so, we may disclose your information to others, who can use the information for the purposes to which you have agreed with them (as such purposes are disclosed in their privacy policy if you have consented to it or how you have otherwise agreed with them they can use it).
When we share or transfer your information to third-party service providers acting on our behalf, we contractually require them to handle the information they receive in accordance with this Privacy Policy. Examples of such transfers to third parties include transfers to:
- Our business partners that may provide you with services (e.g., SiriusXM)
- Your Mercedes-Benz dealer (e.g., to inform them that you have activated the services)
- Our parent company Mercedes-Benz Group and our Affiliated Businesses
- Our third-party content providers, which may provide you with the information or services you request. For example, we may share information that does not reasonably identify you or your vehicle with third parties that provide traffic or other location-based information or services.
Where you have authorized us to do so, we may disclose your information to other parties for their use, primarily so that they can provide their services to you. For instance, if you wish to activate services provided by a third party, you may authorize us to disclose information we collect to that third party, consistent with your authorization or consent. You may also be asked to rate a service provided by a third party; your anonymous rating will be shared with that service provider.
We may also disclose your information to emergency and roadside assistance providers (e.g., roadside assistance services and 911 emergency response), and with law enforcement if you have requested stolen vehicle location assistance services.
We may also disclose your information, including some Geolocation Information, to MBFS, who may use the information subject to its own privacy policy , including verifying fraud, vehicle repossession e in the event of a breach of your lease or finance agreement, and to support vehicle recovery.
Additionally, we may also disclose your information to comply with the law; to respond to claims; to comply with legal process served on MBC or our parent company Mercedes-Benz Group (e.g., a lawful subpoena, warrant, or court order); to enforce or apply our policies or agreements (including to bill and collect payments); to protect and defend our rights or property or that of Mercedes-Benz Group, our Affiliated Businesses, dealers, customers, employees, visitors, or the public; in connection with a business transfer, sale, liquidation, or merger; and if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure; or as otherwise required or permitted by law.
Geolocation Information: We may share or disclose Geolocation Information to support location-based services as previously listed.. When you sign up for these or other services, you may receive additional information about how we share Geolocation Information in association with the specific services.
Driving Behaviour Information: We may share or disclose Driving Behaviour Information to support the provision of services, such as Tracking Services, Vehicle Monitoring, and Product Improvement services. When you sign up for these services, you may receive additional information about how we share Driving Behaviour Information in association with the specific services. For clarity, and as stated in in Part I, MBC does not share information to insurance providers in respect of driver behaviour.
Please note that certain services may involve the sharing of information, including Geolocation Information and Driving Behaviour Information, with authorized users of your Mercedes me connect services (e.g., household members). For example, authorized users can view Geolocation Information and Driving Behaviour Information when Tracking Services and Vehicle Monitoring are active. Please review applicable service descriptions for more information.
Personal profiles established within your user account may be available to other users of your vehicle. To delete profiles from your vehicle, you may need to delete the profile within the Mercedes me connect Customer Portal as well as within the vehicle.
We may also provide aggregated data about our Mercedes me connected subscribers and related telematics service information to third parties, but these statistics will not include information that can reasonably identify you or your vehicle.
5. Your Choices
Withdraw your consent or opt-out of the collection of personal information: In some circumstances, you may be able to remove personal information you have posted in your account by simply logging in to your account and deleting it.
You can withdraw your consent to the collection of your personal information, subject to legal or contractual restrictions, via the Mercedes me connect portal and following the instructions there. You may also be able to deactivate specific services via the Mercedes me connect portal. You can contact Mercedes me connect Support for additional information on how to opt out of data collection or deactivate services: 1-800-387-0100 or can.enquiries@cac.mercedes-benz.com. Please note that opting out of the collection of your personal information may disrupt or disable certain Mercedes me connect services.
You may request to review and update or correct your personal information at any time by emailing us at PrivacyOfficer@Mercedes-Benz.ca.
6. Deletion of Data
You can delete Geolocation Information used for features such as Geofencing, Vehicle Tracker, Car-to-X- Communication, Parking for Navigation, Remote Vehicle Finder or Vehicle Locator by deactivating the services. To deactivate certain location-based services, you may need to contact the CAC without using your vehicle’s communications features. This prevents unauthorized disabling of location services.
Security and Data Storage: We endeavor to protect the data we collect. We use commercially reasonable physical, technical, and administrative security measures designed to protect information against loss and unauthorized access or use. However, we cannot guarantee or warrant the security of your personal information, especially during data transmission.

7. Security Safeguards
Just as with other personal information you provide to us, the information we collect via the Mercedes me connected services is protected against loss, theft, and unauthorized access, disclosure, copying, use, or modification with security safeguards appropriate to the sensitivity of the personal information. We protect personal information regardless of the format in which it is held. For more information on how we protect personal information, please see Part I 8. How does MBC Protect Personal information” of this Privacy Policy.
8. MBC may Transfer Personal Information to Other Countries
Please note that personal information may be stored, accessed and processed outside of your province or territory of residence, including outside of Quebec, and in any country where MBC or its Affiliated Businesses are located, or engages service providers, including in the United States and certain countries within the European Union, including Germany. Those jurisdictions may not have the same data protection laws as Canada. and personal information stored in other jurisdictions may be accessed by foreign governmental authorities and law enforcement institutions in accordance with the laws of those jurisdictions. By using our products, the services, or otherwise providing information to us, customers consent to the transfer of their personal information to jurisdictions outside of Canada, and their province/territory of residence, including outside of Quebec.
Part III
General Information
1. Personal Information
Throughout this Privacy Policy Personal information is considered to be information relating to an identified or identifiable natural person, for example, your name or your personal contact details, as well as other information with which you can be identified directly or indirectly. In the context of your connected vehicle, it can include things like driver behaviour, location information about the vehicle, information about the use of the Mercedes me connect services, or other information a person generates by using the vehicle or the Mercedes me connect services.
2. Changes to this Privacy Policy
We may amend or update this Privacy Policy from time to time. In such event, we will post the revised Privacy Policy at this location. In some circumstances, we may take reasonable steps to alert vehicle owners and registered users prior to the change.

MBC’s Privacy Officer reviews all complaints and informs the complainant of the results of any investigation of a complaint.
In the event the complainant is not satisfied with the results of the complaint made to MBC’s Privacy Officer, the customer may contact the Office of the Privacy Commissioner of Canada, or in some provinces, the provincial privacy commissioner.
4. Definitions
The following definitions apply in this Privacy Policy:
Affiliated Businesses: Our affiliated lines of businesses and programs that develop, enhance, market, and/or provide MBC consumer products, services, and marketing. Affiliated businesses include Mercedes-Benz Group AG, Mercedes-Benz Financial Services Canada Corporation and all worldwide subsidiaries of Mercedes-Benz Group AG.
Business Partners: Organizations with which we have an alliance or arrangement to provide our customers with products or services that may be of interest to them, but which we do not offer directly. This includes Mercedes-Benz dealerships. Business partners also include organizations with which we work in order to conduct market research so that we may better understand our customers’ interests and automotive needs.
Collection: Gathering, acquiring, or obtaining customer personal information from any source.
Consent: A customer’s voluntary agreement with what is being done or proposed. Consent may either be implied or express. Express consent is given in an explicit manner, either orally or in writing. Implied consent may be reasonably inferred by the action or inaction of the individual (e.g. customer presenting a driver’s license so we can authorize a test drive).
Customer: An individual person who purchases, or expresses an interest in, an MBC product or service. This includes potential customers with whom we have established, or are in the process of establishing, a customer profile by collecting personal information. References to “your” or “you” herein are references to Customer.
Disclosure: Making personal information available to other individuals or organizations outside of MBC (including to our Affiliated Businesses) for their own purposes.
MBC: Mercedes-Benz Canada Inc., a Mercedes-Benz Group AG Group company and the exclusive distributor of Mercedes-Benz vehicles in Canada. MBC may also be referred to herein as “we”, “us” and “our”.
Mercedes-Benz dealerships: Independently owned and operated Mercedes-Benz dealerships.
MBFS: Mercedes-Benz Financial Services Canada Corporation, a full-service finance company that provides Mercedes-Benz dealers and their customers with auto financing options.
Personal Information: Any information about an identified or identifiable natural person which could be used either alone or with other information to identify a customer, such as name, address, birth date, financial information, driver behaviour in relation to a connected vehicle etc.
Service providers: Organizations or individuals that perform services on our behalf and for our purposes.
Use: Handling or processing of personal information within MBC or on behalf of MBC by a service provider.
Websites: MBC’s websites include the MBC website (www.mercedes-benz.ca), the Mercedes me Portal (www.me.mercedes-benz.ca) and the Mercedes me Store (https://shop.mercedes-benz.com/en-ca/connect), as well as other websites owned, operated, or controlled by MBC and on which we post this Privacy Policy, from time to time.
