Mercedes me ID Service Terms

Mercedes-Benz Group (hereinafter "MBAG", "we" or "us") with its registered office at Mercedesstraße 120, 70372 Stuttgart, Germany (VAT number DE 32 12 81 763, company registration number HRB 762873, telephone +49 711 17 0), is the provider of the Mercedes me ID service ("Mercedes me ID Service"). The Mercedes me ID Service provides you with a central user account which can be used for the subscription to and/or the use of various other services, including online and offline services (the "Mme Services") provided by Mercedes-Benz Group companies or third parties (each a "Mme Service Provider"). If you are underage, please make sure that your legal representative(s) (e.g. your parent(s)) approve of you subscribing to and/or using the Mercedes me ID Service.

These Mercedes me ID Service Terms ("Terms") constitute the legal basis for your subscription to and your use of the Mercedes me ID Service. It is required that you agree to the Terms. We therefore ask you to read them carefully.

Please note that the Terms only govern the Mercedes me ID Service. The Mme Services provided using your Mercedes me ID are subject to separate service terms to which you will be asked to agree if you decide to subscribe to and/or use those Mme Services. Some of the Mme Services may not be free of charge. Please also note that you may have to meet additional requirements in order to subscribe to and/or use certain Mme Services.

We reserve the right to update these Terms in order to reflect changes in the law or meet regulatory requirements that apply to the Mercedes me ID Service. You will be notified no later than 30 days prior to any change to these Terms and are entitled to cancel this contract without any charge by contacting us at

within these 30 days of the notification of the changes to these Terms that you wish to terminate this contract.

The Mercedes me ID as a central user account requires certain data from you which is identified as mandatory in the registration process ("Mandatory Data"). Mandatory Data has to be correct and complete. In addition to the Mandatory Data, you can voluntarily add additional information ("Voluntary Data") to your Mercedes me ID (Mandatory Data and Voluntary Data together "Mercedes me ID Data") in order to enhance your user experience and to ease the subscription process for certain Mme Services. The more information you add to your Mercedes me ID, the less information you are likely to be asked to provide when subscribing to and/or using another Mme Service. We encourage you to keep your Mercedes me ID Data updated at all times.

When you subscribe to and/or use a Mme Service, the Mme Service Provider is granted access to your Mercedes me ID Data which is required for the subscription to and/or the use of that Mme Service. Furthermore, that Mme Service is linked to your Mercedes me ID and makes use of your latest Mercedes me ID Data.

You have been informed and you understand that in order to provide you with the Mercedes me ID Service, we will process your personal data, i.e. any information relating directly or indirectly to you (such as your name, your e-mail address etc.). Furthermore, you have also been informed and you understand that we will process your personal data strictly in accordance with applicable data protection laws and our Mercedes me ID Privacy Policy. These Terms are subject to the Mercedes me ID Privacy Policy; such policy, however, is not part of these Terms.

Please use unique log-in details for your Mercedes me ID and keep such log-in details confidential and do not disclose them to third parties. You are responsible for all activities carried out under and/or in connection with your Mercedes me ID except where you have taken all reasonable steps to keep your log-in details confidential. You must not misuse the Mercedes me ID Service; in particular, do not use the Mercedes me ID Service in a way or for a purpose that is not permitted by law or that may violate any third party rights.

If you have any complaints about the operation of the Mercedes me ID Service, please contact us via e-mail or please call us at your local telephone number, that you find both in section 12 of these Terms.

If you are resident in the European Union or Norway, Iceland, and Liechtenstein, please note that the European Commission has established an internet platform for online dispute resolution (so called "ODR platform"). The ODR platform is a point of entry for out-of-court resolutions relating to contractual obligations of online sales contracts. All intellectual property rights in the Mercedes me ID Service remain with us; we do not grant you any right to use any logo or trademark and/or other of our intellectual property unless needed to subscribe to and/or use the Mercedes me ID Service.

In order to be able to subscribe to and/or use the Mercedes me ID Service, you need to have an active e-mail account (i.e. your e-mail address) and a (mobile or stationary) device (e.g. your smartphone, your desktop computer, your laptop etc.) connected to the Internet. You may access the Mercedes me ID Service from any standard browser such as Internet Explorer, Mozilla Firefox, Google Chrome, Safari etc.

Please note that the subscription to and/or use of a Mme Service may be subject to further technical requirements of which you will be made aware separately by the relevant Mme Service Provider.

Although we will make reasonable efforts to make the Mercedes me ID Service to be available for use, we reserve the right to temporarily limit, restrict or suspend the Mercedes me ID Service from time to time in order to maintain, restore and/or improve the access to and/or the availability, security and integrity of the Mercedes me ID Service.

In the event that MBAG is liable in accordance with applicable laws for damages caused by slight negligence, the liability of MBAG shall be limited as follows: Liability exists only if material immanent obligations arising from the use of the Mercedes me ID Service have been violated, in particular those which are imposed upon MBAG in accordance with the spirit and purpose of the Terms or whose performance is a prerequisite for the due and proper performance of the Mercedes me ID Service, where you regularly rely and ought to be able to rely upon compliance with such obligations. This liability is limited to typical damage foreseeable at the time the Terms take effect.

Regardless of the issue of fault, this shall not prejudice the liability of MBAG if MBAG has provided a guarantee or accepted a procurement risk, or under the terms of the German Product Liability Act or other applicable product liability laws.

Personal liability on the part of the legal representatives, vicarious agents and employees of MBAG is excluded in cases of damage resulting from MBAG's slight negligence. For damages resulting from the MBAG's gross negligence, with the exception of legal representatives and officers of MBAG the limitation of liability regulated in this regard for MBAG shall apply accordingly.

The limitations of liability set forth in this clause do not apply in the event of death or personal injury.

You may delete your Mercedes me ID at any time. In that manner, you will terminate the agreement between you and MBAG for the provision of Mercedes me ID Service. Please note however that after deletion of your Mercedes me ID, you might not be able to use certain Mme Services that require your Mercedes me ID. If you would like to continue to use or use such Mme Services again, you will have to re-register for a new Mercedes me ID. The subscription to and/or use of certain Mme Services with such a re-registered Mercedes me ID may be subject to costs, which will be communicated to you at the time of re-registration.

We reserve the right to terminate this agreement with one month's advance notice where we terminate the provision of the Mercedes me ID Service. We may also suspend and/or terminate your use of the Mercedes me ID Service with immediate effect in case we have a reasonable suspicion of fraud or other abuse in the use of your Mercedes me ID or Mercedes me ID Service. Where possible we will provide you a notice before such suspension and/or termination. We will in any case inform you of the reason why we have suspended and/or terminated your use of the Mercedes me ID Service, and you will have a right to complain to such suspension and/or termination by contacting your local Mercedes me ID Support contact (refer to section 12 of these Terms). Where the violation can be remedied or the termination and/or suspension was based on incorrect grounds, we will provide you access to your Mercedes me ID Service.

1. This central access service offered by Mercedes-Benz Group allows you to set up your own user account, which you can use to log in to all websites and applications of the Mercedes-Benz Group and its brands linked to this service. Having a user account and password provides you with personalised access to the relevant websites and applications.

2. Mercedes-Benz Group uses the data provided at the time of registration solely for the purpose of providing the central access service. If you log in to a linked website or application using this user account, the Mercedes-Benz Group unit offering this website or application will obtain access to any registration data collected. You can also set up a separate user account for a linked website or application. In this case, two separate registrations will be created.

3. In order to protect your user account, you must choose a password that meets the following criteria:

       a. At least 8 characters long

       b. Includes capital letters

       c. Includes lower case letters

       d. Includes at least one number

       e. Includes at least one special character

   Also, do not use a password consisting of one or more dictionary entries and numbers. Change your password regularly and do not share it with anyone. You can change your password at any time in your user account settings. You are responsible for keeping your password secure. Mercedes-Benz Group accepts no liability for the consequences of failing to comply with these password rules.

   When using the central access service, we urgently recommend protecting your devices against misuse by third parties by means of the measures available for your end devices (e.g. device password, graphical pattern etc.).

4. Your user name is the e-mail address and/or mobile phone number that you provided when you registered. All the information you need to use your account will be sent to this e-mail address or mobile number. You can specify a different e-mail address and/or mobile phone number as your user name at any time in the user account settings.
5. This access service gives you the option to grant certain third-party providers access to individual websites and applications which are allocated to your user account and linked to this service - if available. If you set this up, Mercedes-Benz Group will send the third-party provider means of authentication, which it may revoke at any time. In addition to this set-up, it may be necessary for you to agree to separate terms and conditions of use for the website or application of your choice that is linked to this service.
   
6. You can delete your user account at any time. Please note: Once the user account is deleted, personalised use of linked websites and applications is no longer possible.
7. We reserve the right to regularly update the terms and conditions of access and cookies in order to incorporate the latest functions and technologies into our service.
